Terms of Service

1. Services and Pricing

Clients may choose individual services or a bundled package. All pricing is in AUD and inclusive of GST.

Service Pricing:

  • Ad campaign management – $1,000 per month
  • Organic account management:
     • Standard – $800 per month (up to 2 posts/week)
     • Advanced – $1,200 per month (up to 4 posts/week)
  • Content videography:
     • Weekly – $4,000 per month
     • Fortnightly – $2,000 per month
     • Monthly – $1,000 per month
     • Bi-Monthly – $500 per month
     • Quarterly – $400 per month
  • Standalone video shoots:
     • Small – $1,000
     • Medium – $1,500
     • Large – $2,000
     • Extra Large – $2,500
  • Lead management software – $100 per month
  • Personal receptionist – $900 per month

2. Default Packages

The Delegator – $7,200 per month
Includes:

  • Advanced social media management
  • Weekly professional video shoot (Small)
  • Ad campaign management
  • Lead management software
  • Personal receptionist
    Success Warranty: $1M revenue in 12 months

Lead Engine – $2,900 per month
Includes:

  • Standard social media management
  • Monthly professional video shoot (Small)
  • Ad campaign management
  • Lead management software
    Success Warranty: $150K revenue in 3 months

Brand Booster – $1,800 per month
Includes:

  • Standard social media management
  • Monthly professional video shoot (Small)
    Success Warranty: 300 followers across Facebook/Instagram in 3 months

2A. Custom Packages

Clients may create a custom monthly package by selecting individual services. All custom packages:

  • Require a minimum 3-month commitment
  • Can be adjusted as often as a monthly basis, even within the initial 3 months
  • Any adjustments to the service scope provided must be changed via our Service Alteration Form

Success Warranty Eligibility:

$1M Revenue Guarantee (12 months) – Requires:

  • Ad campaign management
  • Advanced social media management
  • Weekly content videography
  • Lead management software
  • Personal receptionist

$150K Revenue Guarantee (3 months) – Requires:

  • Ad campaign management
  • Standard or Advanced social media
  • Weekly, fortnightly or monthly content videography
  • Lead management software
    (Does not apply if $1M warranty applies)

300 Follower Guarantee (3 months) – Requires:

  • No ad campaign management
  • Standard or Advanced social media
  • Weekly, fortnightly or monthly content videography

We will confirm your applicable warranty during the proposal process. If you do not meet any of the above criteria - then you do not qualify for the success warranty.

3. Service Definitions

  • Ad campaign management: Strategy, setup, testing, optimisation, and reporting across Meta platforms.
  • Organic social media management:
     • Standard – Up to 2 posts/week
     • Advanced – Up to 4 posts/week
     Posting is based on content provided and internal scheduling.
  • Organic Social Posting Terms:
     • Client must supply content (photos/videos from site).
     • Missed uploads may result in paused posting without refund.
     • We may use video shoot footage at our discretion if suitable.
  • Content videography:
     • All package-included shoots are Small Shoots.
     • Upgrades to Medium, Large, or Extra Large available at additional cost.

Shoot Sizes and Inclusions:

  • Small Shoot:
     • Up to 30 seconds of final edited content
     • Max 1 location
     • Max 1 hour on site
     • Max 1 video delivered
  • Medium Shoot:
     • Up to 60 seconds of final edited content
     • Max 2 locations
     • Max 2 hours on site
     • Max 2 videos delivered
  • Large Shoot:
     • Up to 90 seconds of final edited content
     • Max 3 locations
     • Max 3 hours on site
     • Max 3 videos delivered
  • Extra Large Shoot:
     • Up to 120 seconds of final edited content
     • Max 4 locations
     • Max 4 hours on site
     • Max 4 videos delivered

Note:
The shoot concludes once either the maximum time or the maximum number of videos is reached — whichever comes first.

  • Lead management software: CRM, automation, email marketing, review collector, and dashboard access.
  • Personal receptionist: Handles inbound lead responses, books appointments, and follows up.
  • Ad spend: Paid directly by client to platforms (Meta, Google). Not included in BC Digital fees.

4. Success Guarantee

If we don’t deliver the promised outcome by the end of your warranty period, we will continue working at no additional service fee until the outcome is achieved or until 3 additional months pass — whichever comes first.

  • Ad spend is not included and must continue to be paid.
  • Guarantee is void if:
     • Payment is missed
     • Campaign is paused or cancelled
     • Client responsibilities (see Section 5) are not upheld
  • Client must submit a written claim to ethan@bcdigital.com.au within 10 calendar days after the warranty period ends.
  • Supporting documentation (e.g. sales reports & P/L report) may be required.
  • Campaigns must be solely managed by BC Digital during the warranty period.
  • Minimum ad spend of $1,000/month is required to qualify.
  • If services are paused, the warranty period is paused and the 3 months resets as momentum will be lost.

5. Client Responsibilities

You agree to: (for as many apply to your chosen package)

  • Attend sales appointments and send timely quotes
  • Join monthly review calls with our team
  • Maintain funded ad accounts with direct platform billing
  • Supply content (photos/videos) for organic social posting
  • Follow up all leads professionally and promptly
  • Respond to communications in a timely manner
  • Avoid engaging additional marketing agencies without consent
  • Maintain consistent pricing, services, and structure during campaigns
  • Participate in setup tasks like pixel, CRM, and onboarding

Failure to follow the above may void your success warranty at our discretion.

6. Payment Terms and Cancellation

  • All services have a 3-month minimum commitment
  • Early cancellations require payment of the full 3-month term
  • After 3 months, cancellations require 30 days' written notice via our cancellation form
  • Any invoice during the notice period must be paid
  • A video exit interview is required before cancellation is processed
  • Non-payment may result in service pause or termination
  • Manual payment processing incurs a $25 admin fee
  • Payment of invoice or email confirmation constitutes agreement to these terms

7. Pausing Services

  • Services may be paused with 14 days' written notice via our pause form
  • Outstanding invoices must be paid before the pause begins
  • A resume date must be nominated
  • Maximum pause duration is 3 months
  • Missed shoots during a pause are forfeited
  • Warranty periods pause during a service pause
  • Pauses do not affect your contractual minimum term

8. Liability Disclaimer

  • We are not liable for:
     • Financial loss or missed opportunity
     • Reputation damage or business disruption
     • Lead conversion performance or quoting issues
  • Results may vary due to:
     • Sales process
     • Market conditions
     • Platform outages
     • Client responsiveness
  • Platform-related downtime or billing issues (e.g. Meta) are outside our control
  • Campaign performance may vary during seasonal periods or due to external changes

9. Confidentiality

  • You agree not to disclose or replicate any confidential information, strategies, or internal systems of BC Digital.
  • This obligation continues after service termination.
  • Breach of confidentiality may result in legal action.

10. Intellectual Property

  • BC Digital retains ownership of all creative materials unless agreed otherwise in writing
  • Clients are granted a license to use edited assets for their own business use only
  • Redistribution, resale, or third-party use is prohibited without consent
  • Raw files or project files are not included unless purchased separately
  • We may use footage in our portfolio

11. Force Majeure

We are not liable for service delays caused by events beyond our control, including:

  • Illness
  • Natural disasters
  • Bank/payment failures
  • Platform outages
  • Internet service issues
  • Technical faults

12. Video Shoots

  • Included package shoots are Small Shoots unless upgraded
  • Additional footage, locations, hours, or edits incur additional cost
  • Locations must be clean and camera-ready
  • Travel >30km from the videographers / BCD location incurs $100/hr travel surcharge
  • Delays on site reduce available shoot time
  • Shoots end when time or footage limits are reached
  • All footage is edited at our discretion

13. Client Responsibilities for Video Shoots

You agree to:

  • Schedule shoots within the correct period (e.g. monthly)
  • Appear on camera or assign a delegate
  • Prepare filming locations
  • Provide access to all sites in advance
  • Cover any third-party costs (e.g. props, actors)
  • Supply required brand assets ahead of time
  • Unused shoots expire after 1 month
  • Limit filming to shoot tier inclusions
  • Allow our team creative control if no guidance is provided

14. Cancellations and Rescheduling

  • A $500 cancellation fee applies to any booked shoot cancelled after confirmation
  • 72+ hours' notice is required for free rescheduling
  • Less than 72 hours' notice may result in forfeiture
  • If a shoot can’t go ahead due to access issues or lack of preparation, it is forfeited
  • One reschedule per shoot allowed; additional reschedules incur 50% rebooking fee
  • Weather-related reschedules are at BC Digital’s discretion

15. Revisions and Delivery

  • One round of video revisions included per shoot
  • Revisions must be requested within 7 days of delivery
  • Additional revisions billed at $150/hour
  • Delivery time is 10 business days post-shoot
  • Urgent delivery (under 5 days) may incur rush fees
  • Videos delivered via secure download link
  • Raw or project files not included unless pre-arranged

16. Ownership and Usage Rights

  • All content remains property of BC Digital
  • You are licensed to use final videos for your own business only
  • Use with other providers or redistribution is not allowed
  • Raw/project files available at extra cost
  • We may use footage for promotional purposes unless confidentiality is requested

17. Dispute Resolution and Governing Law

  • Governed by the laws of New South Wales, Australia
  • Disputes must attempt mediation within 30 days of formal written notice
  • Mediation to be virtual or in-person with a neutral mediator
  • Failing mediation, disputes may proceed via legal channels in NSW
  • Non-payment may be referred to debt collection
  • Payment or email confirmation constitutes agreement to these terms
